SHAH ALAM, Dec 23 — The High Court here today dismissed Ismanira Abdul Manaf’s application to postpone her five-year prison sentence for neglecting her six-year-old son, Zayn Rayyan Abdul Matin, resulting in physical injuries two years ago.
Judge Datuk Aslam Zainuddin ruled that there were no special circumstances that would justify delaying the sentence while awaiting appeal.
“After reviewing the applicant’s and respondent’s affidavits, the written submissions of both parties, and hearing oral arguments, the court finds that the application to stay the execution of the sentence is refused, as there are no exceptional circumstances to allow it,” he said.
The prosecution was represented by deputy public prosecutors Mohd Izham Ali and Ahmad Iqbal Azman, while the defence was led by lawyer Haresh Mahadevan, assisted by Ramzani Idris and Lavanesh Haresh.
Ismanira, 30, filed the application on November 19.
On October 31, the Petaling Jaya Sessions Court sentenced Ismanira to five years’ imprisonment after finding her guilty of neglecting her autistic child, which resulted in physical harm.
Judge Syahliza Warnoh ruled that the defence had failed to raise reasonable doubt in the prosecution’s case.
Ismanira was ordered to begin her prison term from October 31, in addition to signing a two-year good behaviour bond with a guarantor and a RM3,000 surety. She was also directed to complete 120 hours of community service within six months of finishing her prison term.
