KUALA LUMPUR, Jan 7 — The government has decided to impose provisional anti-dumping duties ranging from 6.33 per cent to 37.44 per cent on imports of polyethylene terephthalate (PET) originating or exported from China and Indonesia, said the Investment, Trade, and Industry Ministry (Miti) today.
It said the move is necessary to prevent injury to the domestic industry following the completion of the preliminary determination of the anti-dumping duty investigation as provided under section 23 of the Countervailing and Anti-Dumping Duties Act 1993.
“The government has found that there is sufficient evidence to continue with further investigation on the importation of the subject merchandise from China and Indonesia.
“Therefore, the government has decided to impose a provisional measure, which shall be in the form of provisional anti-dumping duties guaranteed by a security equivalent to the amount of the dumping margins determined in the preliminary determination,” Miti said.
Anti-dumping duty investigations on imports of PET originating or exported from the said countries were initiated on August 9 last year, following a petition by Recron (M) Sdn Bhd on behalf of the domestic industry.
The petitioner claimed that imports of PET originating or exported from these countries are being sold into Malaysia at a price lower than the selling price in their domestic market, causing material injury to Malaysia’s domestic industry.
Miti said the provisional anti-dumping duties will be applied to imports of subject merchandise from China and Indonesia and shall be effective for no more than 120 days, beginning today.
“A final determination will be made no later than May 6, 2025,” it said.
Interested parties, including importers, foreign producers, or exporters and associations related to the investigation are welcome to provide comments or views on the report of the preliminary determination to Miti by 5.30pm next Friday (January 17).
They can access the non-confidential version of the report on the preliminary determination by submitting a written request to the ministry.
