MBSJ fines condo management for failing to hold AGMs

SUBANG JAYA, Jan 31 — The Subang Jaya City Council (MBSJ) has issued three compounds against the management of Main Place in USJ 21, after it failed to hold its annual general meeting (AGM) within the specified period.

Subang Jaya Mayor Datuk Mohd Fauzi Mohd Yatim said the Building Commissioner's Department (COB) discovered the serviced apartment complex's management corporation did not hold its second and third AGMs in 2021 and 2023.

"Compounds were issued in accordance with the Strata Management Act 2013 (Act 757), which stipulates the AGM must be held once a year with an interval of no more than 15 months.

"In addition, Main Place's Joint Management Body (JMB) has also been fined for failing to submit receipts to the COB after appointing an unregistered property manager from 2017 to 2019," he said during MBSJ's monthly meeting at the council's headquarters today.

Fauzi added the compounds were issued in accordance with Subregulation 21(5) of the Strata Management Regulations (Maintenance and Management) 2015 under Act 757.

"A RM25,000 compound offer notice was imposed for each offense, and the management has been given a 14 day period to settle it.

"If no payment is made, prosecution action can be taken and a fine not exceeding RM50,000, imprisonment not exceeding three years, or both, can be imposed for each offense," he said.

Fauzi advised Main Place's management to fulfill their obligations as stipulated by Act 757.

"This is to avoid compound actions and prosecutions in court. The AGM is the main platform for all strata property owners to discuss and make decisions to ensure building management and maintenance can be carried out more systematically," he said.
