MPK: State authorised to take over illegal dump site in Kapar or proceed to court

KLANG, Dec 18 – The Selangor government is set to address the illegal dumping site on 12 private land lots at Batu 14, Kapar after landowners failed to rehabilitate the area within the deadline.

Klang Municipal Council secretary Zaireezal Ahmad Zainuddin said the state could either take legal action or take over the land, as the landowners needed to clean up the site within one month. He said the notice was issued in May under the Local Government Act 1976 (Act 171).

“A review found that 12 lots were involved, but the council only identified four rightful owners and issued notices to rehabilitate the land within a month. However, the deadline has passed, and in this case, the council will not clean (the ground) as it is privately owned; it is the owners’ responsibility to do so.

“The owners failed to clean up, and the state government needs to decide whether to take legal action or take over the land. (This matter) is under discussion,” he said yesterday.

Zaireezal also stated that the council had cleaned up some of the bulk waste in the area and extinguished the fires at the site to prevent disruptions to the residents.

On December 8, the Menteri Besar Dato’ Seri Amirudin Shari said that the state administration could not immediately take over land used as illegal dumpsites at Batu 14, Kapar, Klang.

Instead, Amirudin said that a certain period must be given to the owners to rehabilitate the land before further action is taken.

The issue gained attention after approximately 100 residents protested peacefully and submitted a memorandum regarding the foul odour from the 1.2-hectare domestic waste disposal site.

The ongoing situation in the said area involved seven different neighbourhoods, namely Sungai Serdang, Kampung Batu 12, Kampung Tok Muda, Kampung Bukit Kerayong and Bukit Kapar.
